The Agreement

This agreement is between Nexis ("we") and the Client ("you") for the design, build, and care of the website described below.

The work. A custom website built to your brand: your project — including copy placement, photo production, a contact form, and local search setup. The site you have already previewed is the deliverable.

Payment. A one-time retainer of $, due on signing, which covers the design and build of your website. From launch, $/month covers everything to keep it running — your domain name, hosting, security, software updates, the contact form, and content changes whenever you need them. No separate bills.

Going live. Your site launches at your own domain once the retainer is received. The domain is registered and renewed by Nexis as part of your monthly plan; if you ever leave, it transfers to you.

Ownership. Your content — photos, wording, brand — is always yours, from day one. After 12 months of continuous service, full ownership of the website itself transfers to you. Until then, Nexis hosts and maintains it as a managed service.

Cancelling. The monthly plan runs for a minimum of 12 months. After that, either of us can end it with 30 days' written notice. If payments stop, hosting may be paused until the account is current.

Changes. Content updates are included in the care plan. New features or pages beyond the original scope are quoted separately before any work begins.

The Agreement

This agreement is between Nexis ("we") and the Client ("you") for the social media content and posting described below.

The work. Nexis creates and publishes branded social content for your business — one creative post per day to Instagram and one to TikTok — designed from your products and brand, including the creative, captions, hashtags, and scheduling. The creative direction you have already previewed is the starting point.

Term. This agreement runs for 90 days from the start date. Posting begins once the first month's payment is received and account access is provided.

Payment. $1,500/month for the 90-day term — three monthly payments, $4,500 total. The first month is due on signing; each following payment is due on the same day of the next month. No setup fee and no other charges.

Performance guarantee. If, at the end of the 90 days, your business has seen no measurable return — no lift in sales, orders, or social following and engagement over where you started — Nexis refunds the fees you have paid. This guarantee applies as long as you keep the accounts active, give Nexis timely product access and approvals, and complete the full term. Results are measured from your Instagram and TikTok analytics and your store's own order data. This refund is Nexis's only obligation under the guarantee.

Your accounts & content. Your accounts, audience, and brand stay yours throughout. Nexis posts on your behalf and hands over the content it creates and scheduling access. You provide products, brand assets, and account access, and you remain responsible for the accuracy of your product claims and for compliance with each platform's rules and applicable law.

Cancelling & changes. Either of us can end this with written notice; the performance guarantee above requires completing the full 90-day term. Daily organic posting to Instagram and TikTok is the full scope — additional platforms, paid ad spend, or work beyond that is quoted separately before it begins.

This agreement is between Nexis ("we") and the Client ("you") for the website and monthly marketing described below.

The work. Nexis hosts and maintains your website and makes any change you ask for, as many as you want. Each month also includes your Google Business Profile — posts, photos, hours, service area, questions and review replies — new town pages for the areas you serve, a review request you can forward after each job, and a one-page report in plain English.

Payment. Payment is monthly and follows your season — lower when you are quiet, higher when you are busy. The full schedule is below and totals $ across months.

The schedule is one deal. The lower months are below what this work costs to deliver. They are priced that way because the work done in your off-season is what produces bookings in your busy season, and because the higher months are where it is earned back. The two halves are not separate agreements.

Same work every month. Everything listed above is included at every price in the table. A lower payment does not mean less work that month.

Due dates. Each payment is due on the day you choose below. If a payment is more than 10 days late I will text you before anything changes; at 30 days late the monthly work can pause until the account is current. Your website stays online either way.

What I am not doing. No paid ads — that is your money going to Google, separate from me. No promised rankings, call volume, or revenue; anyone who promises those is guessing. I will not take on a directly competing business in your area during this term.

Ownership. Your domain, logo, photos, content, Google profile and customer information are yours from day one. You own the website itself once the term is complete or once you have paid through your final month. If we part ways I will export the site, hand you the files, and transfer anything in my name to yours within 14 days.

Cancelling. Either of us can end this with 30 days' written notice — a text counts. If you end it early you owe the months already completed plus the notice period, and nothing more. No penalty and no clawback of the lower months.

The Agreement

This agreement is between Nexis ("we") and the Client ("you") for a website built and hosted at no charge, in return for the promotion described below.

The work. Nexis builds your website from the version you have already seen — your photos, hours, services, and a phone number that dials when it is tapped — and puts it live at your own domain within seven days of your go-ahead. The seven days pause while Nexis is waiting on you for photos, wording or domain access. For the full 12-month term Nexis hosts the site, keeps it secure, and makes content changes whenever you ask.

What it costs you. Nothing. No build fee, no monthly fee, no hosting bill, for the whole term, and no bill at the end of it. The one thing that stays in your name and on your card is the domain name itself, paid to the registrar, not to Nexis; if it has lapsed, Nexis will re-register it with you so it is yours.

What you do in return. Four things. None of them costs money.

1. A "Site by Nexis" line in the footer of the site, linked to nexis-us.com, for the full term.

2. A Nexis QR sticker, supplied by Nexis, displayed where your customers see it — the counter, the door, or the truck.

3. Three introductions within 30 days of launch: three business owners you know, each introduced by name, in a text or in person, with the words "talk to Jay." The introduction is the whole ask. Whether they hire Nexis is up to them.

4. Permission to name your business, show the site, and film it as a Nexis case study, on nexis-us.com and on social media. You see anything that names you before it goes out.

What is not asked. A review is not part of this agreement, on Google or anywhere else, and Nexis will never ask for one in exchange for this site. If you choose to leave one on your own, that is yours to decide.

How we both know it worked. The site gives you a tap-to-call number you did not have. For the first 60 days after launch Nexis will ask you to note how each new caller found you, so both of us can see whether the site is doing its job. That is the only measurement in this agreement; no rankings, call counts or revenue are promised.

Ownership. Your content, photos, name, domain and Google profile are yours from day one. At the end of the term the website itself is yours too: Nexis hands over the files and transfers anything in its name within 14 days. If you would like Nexis to keep hosting it after the term, that is a separate agreement, quoted then, and you are free to say no.

Ending it. Either of us can end this with 30 days' written notice; a text counts. The site stays live through the notice period and the files are yours either way. If the footer line or the sticker comes down and is not restored within 14 days of Nexis asking, Nexis may take the site offline at the end of the notice period. Nothing is ever owed in money, by either side.
